Haiti

Haiti is the only independent Francophone country in the Caribbean. It gained its independence in 1804 after a revolution overthrew Napoleon’s forces and expelled the French, making Haiti the first republic in the Caribbean and second in the Americas. Haiti was also the first country in the world to abolish slavery. Haiti shares the island of Hispaniola with its neighbor to the east, the Dominican Republic. Haiti’s positioning makes it a strategic, international port. Its natural beauty – beaches, mountainous terrain, and tropical landscape – draws tourists. However, Haiti and its economy have suffered significant setbacks in recent years due to natural disasters.

Trademark Rights

Trademarks and service marks are eligible for registration in Haiti. The following rules and regulations apply:

  • Prior use: None required

  • Classification: Nice Classification (single class filing only)

  • Registration term: 10 years with proof of use due on the sixth anniversary and tenth year when renewal is due

  • Late renewals are not possible

  • Non-use vulnerability: 5 years
