British Virgin Islands

The British Virgin Islands is a British Overseas Territory made up of numerous volcanic islands. BVI shares the Virgin Islands Archipelago with the United States Virgin Islands. Its economy is based primarily on tourism and financial services.

Trademark Rights

Trademarks are eligible for registration in the British Virgin Islands. The following rules and regulation apply:

  • Prior use: None required

  • Classification: Nice Classification

  • Registration term: 10 years from the date of filing and renewable for 10 year  periods 

  • Non-use vulnerability: 3 years

Extension of Rights

BVI trademarks were based on UK extensions until 2015. The system is now an entirely local one. Priority can be claimed from a registration in a Paris Convention or WTO member state.
