Who Needs IP Portfolio Management Services?

Direct in-house teams:

for in-house counsel who are often handling a worldwide portfolio with a limited number of hands, we can act as your counsel for the region and take the responsibility off your team’s plate

Large law firms:

for firms managing their own portfolio of complex clients, we can take the Caribbean work in house, reducing the amount of correspondence and follow-up needed for your clients’ matters. This streamlines the workflow and reduces the time your team spends.

IP boutiques:

for firms that know just how difficult it is to manage work in the region and recognize strong IP expertise when they see it, Caribbean IP is the go-to option. We speak the language of boutique firms and know how to balance the clients’ needs for innovative solutions with the right price.

Latin American firms who need a regional solution for the Caribbean:

Latin firms managing international work across Central and South America often want a single solution to allow them to extend services to their clients for the Caribbean region as well. Our practice can provide a natural complement to such firms, allowing them to offer top-notch service for the Caribbean in addition to their traditional regions.

Frequently Asked Questions

Still have questions? Take a look at the FAQ or reach out anytime.

  • Yes, we do this for clients all the time! We take whatever data the client can provide and input it into our own docketing system for ongoing deadline monitoring. When our clients’ data is incomplete, we can try to fill in the blanks with local searches.

  • We file recordals whenever there is a change affecting ownership of a mark, whether it be a change of name, a change of address, or a transfer of the mark (through assignment or merger). We also record licenses and liens when needed.

The documents needed vary greatly by jurisdiction: in some, we need original ink signatures and notarized documents, in others simply requesting the change is enough. We know the requirements for each jurisdiction inside and out and take care to ensure what we file is accurate and conforms to local requirements.  Because of this complexity across jurisdictions, and that older portfolios can often have patchy records, mass recordal changes are an opportunity for large brand owners to clean up their portfolios. We love getting granular with the paperwork and making sure all our clients records are structured and complete so if enforcement matters arise, our clients know their portfolio is in the best position.

  • Yes, we’ve actually perfected the art of due diligence needed for these large-scale projects! We have clients who are regularly acquiring new portfolios and have handled many projects covering hundreds of marks in various Caribbean countries and territories.

  • We use WebTMS (now part of AltLegal) for our docketing needs. It is a powerful system that allows us to create custom dockets and reports for effective monitoring of our clients’ matters and provide them with useful reports quickly.

  • Yes, we love to assist clients with portfolio review and with shoring up protection across the region.

Not all jurisdictions are fully computerized, and this can make finding register details difficult, especially for brands with long histories. Our local teams maintain strong working relationships with IP registry staff members in these paper-based jurisdictions, meaning we can be present at the registry to sit down, and carefully and collaboratively work with examiners to solve issues. This may sound insignificant, but this is a key part of our special sauce!

There are still a couple of countries where service mark protection is not yet available, and this can be frustrating for brands used to working in larger jurisdictions like the UK or US. We often, and effectively, advise on registration strategies for these jurisdictions.

Clients often note lack of responsiveness from local counsel as a major issue that leads them to moving to, and staying with, Caribbean IP. If you work with Caribbean IP you will experience the same kind of service you would expect from a leading US or European IP firm.

Clients coming to us from other local counsel have also been frustrated by a lack of clear guidance in filing strategy when marks, designs, or patents require a bit of finesse to ensure registration. We aim to present clients with all available filing and protection options open to them, but more importantly, we tap into our extensive knowledge and experience to give clear guidance on what we think is the best course of action, and why!

  • We work with clients’ counsel directly, and through centralized IP management vendors such as Dennemeyer, Clarivate etc. Our team is adept at conforming to our clients’ varied needs.
